Terms of Service

These Terms of Service ("Terms") are an agreement between you and Musterport ("Musterport", "we", "us") and govern your use of the service. If you use Musterport on behalf of an organization, you agree to these Terms for that organization. By creating an account or using Musterport, you accept these Terms — please read them carefully.

1. Who we are

Musterport is a readiness platform for emergency management and volunteer agencies, operated in the United States. It is currently offered as a free beta.

2. Eligibility & accounts

You must be able to form a binding agreement to use Musterport. You are responsible for the accuracy of the information you enter, for all activity under your account, and for keeping your login credentials confidential. Notify us promptly if you believe your account has been compromised.

3. Beta service

Musterport is in active development and provided free of charge during the beta. Features may change, be added, break, or be discontinued, and the service may be unavailable at times. Do not rely on Musterport as your sole system of record. If we introduce paid plans, we will provide notice before any charges apply.

4. Your data & ownership

You retain all rights to the information you enter. Individuals own their own profile, certifications, skills, and capabilities, and control sharing by joining or leaving organizations. You grant Musterport a limited license to store and process your information solely to provide the service. Organizations and their administrators are responsible for their use of member data and for having the authorization needed to collect and view it. Our handling of personal information is described in our Privacy Policy.

5. Acceptable use

Use Musterport only for lawful purposes. You agree not to breach or probe security, disrupt the service, access data belonging to other organizations, scrape or bulk-export data you're not authorized to access, misrepresent your identity or credentials, or upload unlawful or harmful content.

6. Organizations & administrators

Musterport is organized around agencies. Administrators are responsible for managing member access, for ensuring their members are authorized to view the volunteer information within their organization, and for the accuracy and lawful handling of the records they enter.

7. Not an emergency service

Musterport is a preparedness and readiness tool. It is not an emergency dispatch, alerting, or communications system, and it is not a substitute for your agency's official procedures or systems of record. In an active incident, always follow your agency's official procedures, and call 911 for life-threatening emergencies.

8. Disclaimers

Musterport is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that the information within it is accurate or complete.

9. Limitation of liability

To the maximum extent permitted by law, Musterport and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the service. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim (currently $0 during the free beta) or fifty U.S. dollars ($50).

10. Termination

You may stop using Musterport and delete your account at any time. We may suspend or terminate access if you violate these Terms, or if we discontinue the service, and we will provide reasonable notice where practical.

11. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Missouri will have exclusive jurisdiction over any dispute arising from these Terms or your use of Musterport.

12. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify account holders. Continued use of Musterport after changes take effect constitutes acceptance of the revised Terms.
